Terms and Conditions

These Terms and Conditions apply to all services, products, programs, memberships, subscriptions, digital products, and online courses provided by Jacqueline Smith (sole trader) (“we”, “us”, “our”).
By accessing this website or purchasing any offering, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to purchase our services unless otherwise agreed in writing. You confirm that all information provided is true and accurate and that you have the legal capacity to enter into this agreement.
2. Nature of Services
We provide coaching, education, and personal development services including:
1:1 coaching
group coaching programs
online courses
digital products
memberships and subscriptions
Our services are educational and informational in nature and are not a substitute for medical, psychological, financial, legal, or other professional advice or treatment. We do not diagnose, treat, or cure any condition.
You are responsible for seeking appropriate professional support where required.
3. Client Responsibility
You acknowledge and agree that:
results vary between individuals;
outcomes depend on your participation, circumstances, and implementation;
you are solely responsible for your decisions, actions, and results;
you participate voluntarily and at your own discretion.
4. No Guarantees
We do not guarantee any specific outcomes, including personal, emotional, financial, career, or business results.
Any examples, testimonials, or case studies are illustrative only and do not represent guaranteed outcomes.
5. Fees and Payment Terms
All prices are in Australian Dollars (AUD).
Payment is required in full prior to access unless a payment plan is agreed.
Payment Plans
Where payment plans are offered:
a non-refundable $400 deposit is required to secure your place
remaining payments are charged every 4 weeks as agreed
payments must be made in advance of each billing cycle
failure to pay may result in suspension or termination of access to services
you remain liable for the full program fee
If payments default, we may require immediate payment of any outstanding balance.
We use third-party payment processors and are not responsible for platform errors, delays, or outages.
6. Refunds and Consumer Law
Nothing in these Terms excludes your rights under Australian Consumer Law.
Coaching, Programs, and Courses
All coaching, programs, and courses are non-refundable once accessed or commenced
Coaching and programs may be transferred to another person with written approval
Digital Products
Digital products are non-refundable once delivered or accessed due to immediate access nature
Clarity Sessions
Minimum 48 hours’ notice required to cancel or reschedule
Less than 48 hours’ notice incurs a 50% cancellation fee
Nothing in this section limits your rights under Australian Consumer Law.
7. Cancellations and Rescheduling
We may reschedule or cancel sessions due to illness or unforeseen circumstances. Where this occurs, we will offer a rescheduled session or credit/refund where appropriate and according to the terms of the coaching agreement.
8. Group Programs and Community Conduct
All participants, staff, contractors, facilitators, and members must comply with our Community Guidelines.
We may remove any participant from services or communities for behaviour that is abusive, disruptive, inappropriate, or breaches guidelines, without refund where permitted by law.
9. Recordings and Testimonials
Sessions, workshops, group programs, and courses may be recorded.
By participating, you consent to being recorded and acknowledge that recordings may include your voice, image, contributions, or participation.
Testimonials, feedback, or user content provided may be used for marketing and promotional purposes unless you request otherwise in writing.
10. Intellectual Property
All materials provided remain the intellectual property of Jacqueline Smith.
You are granted a limited, non-transferable, non-commercial licence for personal use only.
You may not copy, reproduce, distribute, share, resell, or modify any materials without written permission.
11. Website Use
You agree not to misuse, disrupt, or attempt unauthorised access to our website, systems, or content.
12. Third Parties and Affiliates
We may use third-party platforms to deliver services including payment processors, course platforms, email systems, and analytics tools.
We are not responsible for third-party services or their availability.
We may use affiliate links and may receive a commission at no additional cost to you.
13. Privacy
We collect and handle personal information in accordance with the Australian Privacy Principles.
We may collect information including your name, email address, payment details, usage data, and information you voluntarily provide during coaching or course participation.
Some data may be stored or processed outside Australia via third-party providers.
14. Limitation of Liability
To the maximum extent permitted by law:
we are not liable for indirect, incidental, or consequential loss
we are not liable for loss of income, opportunity, or emotional distress
our total liability is limited to the amount paid for the relevant service
Nothing in these Terms excludes rights under Australian Consumer Law.
15. Force Majeure
We are not liable for delays or failure to perform due to events outside our reasonable control including illness, natural disasters, internet outages, cyber incidents, or platform failures.
Where possible, services will be rescheduled or credited.
16. Electronic Communications
You consent to receive communications electronically including emails, invoices, and service updates.
Electronic communications satisfy legal requirements for written notice.
17. Disclaimer
All content, including coaching, courses, materials, and communications, is for educational and informational purposes only.
It does not constitute medical, psychological, legal, or financial advice.
You are responsible for your own decisions, actions, and outcomes.
18. Accessibility and Inclusion
We aim to provide an inclusive and supportive environment and will make reasonable efforts to accommodate accessibility needs where practicable.
19. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You submit to the non-exclusive jurisdiction of the courts of New South Wales.
